Surrey doctor found not guilty of sexually assaulting patient

A Surrey doctor has been found not guilty of sexually assaulting a patient at his pain management clinic.

Dr. Olumuyiwa Akinwumi Bamgbade – an anaesthesiologist and interventional pain physician – was charged with sexually assaulting a 66-year-old patient, whose name is shielded by a publication ban, in 2022 during a medical appointment when the two of them were alone in an examination room at the Salem Pain Clinic. Bamgbade didn't testify or call defence evidence. The complainant alleged he gave her a "passionate" kiss and touched her breasts without her consent.  

Surrey provincial court Judge Mark Jetté found the complainant's account "incompatible" with the layout of the room

"To be perfectly clear, I find that those things could not have happened as described by (the complainant) in the small space that was available between the wall and the examination table," Jetté noted in his  "I also find that (the complainant) suggested an alternative narrative – with Dr. Bamgbade further off to the side - when confronted with photographs that demonstrated obvious problems with her original version."

The judge determined that "material inconsistencies and improbabilities" in her testimony "go to the very heart of her allegation that she was sexually assaulted by Dr. Bamgbade, and raise real concerns in my mind regarding the reliability of her account. As I result, I am left with a reasonable doubt that Dr. Bamgbade committed this offence. I find Dr. Bamgbade not guilty."
